ON IMPORT OF RICE

THE MINISTER OF INDUSTRY AND TRADE,

Considering:

Referring to:

Decree of the Minister of Industry and Trade No. 9/MPP/Kep/1/2004 on the importation of rice as has been amended by Decree of the Minister of Industry and Trade No. 351/MPP/Kep/5/2004.

DECIDES:

DECREE OF THE MINISTER OF INDUSTRY AND TRADE ON THE SECOND ROUND OF AMENDMENT TO DECREE OF THE MINISTER OF INDUSTRY AND TRADE NO. 9/MPP/Kep/1/2004 ON THE IMPORTATION OF RICE

Article I

Several provisions in Decree of the Minister of Industry and Trade No. 9/MPP/Kep/1/2004 on the importation of rice as has been amended by Decree of the Minister of Industry and Trade No. 357/MPP/Kep/5/2004 shall be amended as follows:

1. Article 1 shall be amended so that it entirely reads as follows:

"Article 1

Hereinafter referred to as:

1. Rice means:

2. Importer means a company, either private corporate body or state-owned/regional government-owned company, that holds an importer's identification number (API) to import goods;

3. Recommendation means the letter of a relevant agency; unit that provides technical explanations and does not constitute an import permit/approval.

4. The Minister means the Minister of Industry and Trade.

5. The Director General means the Director General of Foreign Trade, Ministry of Industry and Trade."

2. Article 12 shall be amended so that it entirely reads as follows:

"Article 12

(1) The importation of rice by If>-rice or IT-rice shall first be subject to technical verification in the country of loading.

(2) The technical verification referred to m paragraph (1) shall be conducted by a surveyor appointed by the Minister.

(3) In regard to the technical verification referred to m paragraph (2), the surveyor can collect recompenses from the importer/importing agency/grant provider related to the importation of rice, for its services rendered.

(4) To conduct technical verification of the importation of rice, a surveyor shall meet the following requirement:

a. having experience as a surveyor for a minimum of 5 (five) years; and

b. having a branch, representative or affiliate abroad.

(5) Provisions and procedures for conducting the technical verification shall be stipulated by the Director General."

3. Article 13 shall be amended so that it entirely reads as follows:

"Article 13

The technical verification referred to in Article 12 shall not apply to rice which constitutes:

a. goods used for technological research and development;

b. specimen goods;

c. personal goods of passengers or crew members of transport mode or border crossers;

d. promotional goods; or

e. airborne parcel through courier service."

Article II

This Decree shall come into force as from the date of stipulation.

For public cognizance, this Decree shall be announced by placing it in the State Gazette of the Republic of Indonesia.
